According to the attorney I spoke to who specializes in Virginia wetlands issues, only the State can declare a wetlands.
There is a specific and rigorous procedure defined for that purpose, which apparently involves the Army Corps of Engineers (more to come on this later).
Robin Davis of the Henrico Environmental Services Division claims that all Henrico has to do is "think" it's a wetlands, and it is.
Sean Kellogg, the County engineer who walked the flooded land, also said something similar, supposedly wrote a report about it, but ignores my requests for a copy of that report.
Looking into how the State feels about having the County usurp their authority.
Again, why is lying to a citizen not a crime?
Interesting to note that the County never puts any of this in writing, and no one who comes here ever has a business card. Hmmmmm...
